End User License Agreement and Terms of Use

1. Acceptance of These Terms

These terms (the "Terms") are a binding agreement between you and the provider of Parallax (the "Provider"). They cover:

Together these are "Parallax". These Terms are the End User License Agreement referred to in Lemon Squeezy's buyer terms.

You accept these Terms by doing any of the following:

If you do not accept them, do not do any of those things. You must be at least 18, or the age of majority where you live, to buy a license. A minor may use Parallax only with the involvement and consent of a parent or guardian, who accepts these Terms on the minor's behalf. If you accept on behalf of an organization, you confirm that you are authorized to bind it.

2. Purchase and Delivery

Licenses are sold by Lemon Squeezy (Link, LLC, formerly Lemon Squeezy LLC). Lemon Squeezy is the merchant of record and an authorized reseller. Lemon Squeezy's buyer terms govern the payment, taxes, invoices and delivery of your license key. The Provider is not a party to the payment transaction. The price is a one-time payment for the version and updates described in section 6; there is no subscription. Your license key is delivered by email. The Provider is not responsible for errors or delays in the payment or delivery services of Lemon Squeezy or its providers.

3. System Requirements

The Software requires all of the following:

It does not run on Intel-based Macs, Windows, Linux, iPhone or iPad. You are responsible for checking that your Mac meets these requirements before you buy; Apple menu > About This Mac shows the chip and the macOS version. How well head tracking works depends on your camera, lighting and surroundings. Compatibility with future versions of macOS, with other hardware, or with third-party apps and games is not guaranteed.

4. All Sales Final

The Provider does not offer refunds. This includes refunds for change of mind, for a Mac that does not meet the requirements in section 3, for dissatisfaction with the 3D effect, and for not using the Software. Refund requests are handled by Lemon Squeezy under its buyer terms, at its sole discretion. If an order is refunded, reversed or charged back for any reason, its license ends and its key may be revoked.

Right of withdrawal. If you live in the European Economic Area, the United Kingdom, or another place that gives consumers a right to withdraw from online purchases, then by completing your purchase you:

Lemon Squeezy's buyer terms say the same.

Problems. If the Software does not work on a Mac that meets the requirements, email support@parallaxwindow.com first so the problem can be investigated. Lemon Squeezy's buyer terms ask you to contact it before disputing a charge with your bank. Raising a chargeback without a valid reason may lead to your license being revoked.

Nothing in these Terms limits any right you have under consumer protection law that cannot be waived by contract, including any statutory remedy for digital content that is faulty or not as described.

5. License Grant

The Software is licensed, not sold. Subject to these Terms and payment of the price, the Provider grants you a personal, worldwide, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on one Mac at a time that you own or control, for your personal use or your own internal business use. To move the license to another Mac, choose "Deactivate License on This Mac…" in the Parallax menu, then activate on the new Mac. Any attempt at moving the license that is not shown here is not permitted.

The Integrations are provided free of charge under the same terms, for use only with a licensed copy of the Software. All rights not expressly granted in these Terms are reserved by the Provider.

6. Updates, Activation and Support

7. Restrictions

You may not, and may not help or allow anyone else to:

8. Health and Safety Warning

9. Input Handling, Data Loss and High-Risk Use

Parallax redraws your windows in 3D and moves real windows beneath your pointer, so that your clicks, scrolls and keystrokes reach other apps through it. Because of this, input can occasionally reach a different place, arrive late, or have unexpected effects. You are responsible for saving your work and keeping backups.

Do not use Parallax while operating any app or system where an unintended or delayed input could cause:

The Provider is not responsible for the results of inputs passed on by Parallax, or for any loss of data.

10. User Content and Third-Party Content

Parallax processes whatever is on your screen and in front of your camera, on your own device. You are responsible for having the rights and any consents needed for the content you view, capture or convert with Parallax, including:

The Provider claims no ownership of your content and does not receive it.

Apps, games, websites and media shown in or used with Parallax belong to their owners and are governed by their own terms. Content with copy protection may appear blank, and Parallax does not circumvent copy protection. The Integrations modify how third-party games and apps display, and updates to those games and apps may stop them working. Using mods or add-ons may break the terms or anti-cheat rules of a game, server or platform. You are solely responsible for checking those rules, and the Provider is not liable for bans, account actions or other consequences.

11. Privacy

The Privacy Policy explains how information is handled and forms part of these Terms. By turning on the camera in the Software or on the Website, you agree that your camera images may be processed on your device to estimate your head position. As the Privacy Policy explains, this includes locating points on your face. Those images and points are never stored, never sent off your device, never used to identify you, and never received by the Provider.

12. The Website

The Website and its demos are provided for information and demonstration. Demos are illustrations and may differ from the Software. The Website may change, be unavailable, or be discontinued at any time. Prices, features and offers may change without notice before you buy.

13. Intellectual Property

The Provider and its licensors own the Software, the Integrations, the Website and their content, as well as the Parallax name and logo. These Terms give you no rights in them except the license in section 5. The Software includes open-source components that are licensed under their own terms, which are listed in About Parallax in the app. For those components, their licenses apply, and nothing in these Terms limits your rights under them.

If you send suggestions or feedback, the Provider may use them freely without obligation to you.

14. Third-Party Trademarks

Apple, Mac, macOS, Apple silicon and Safari are trademarks of Apple Inc., registered in the U.S. and other countries and regions. Minecraft, Blender, Geometry Dash, Discord, Hypixel, YouTube, Chess.com, Coolmath Games and all other third-party names and logos belong to their respective owners. They are used only to identify the products Parallax works with or displays. Parallax is not affiliated with, sponsored by or endorsed by any of them.

15. Termination

Your license ends automatically if you breach these Terms. The Provider may also revoke a license or key in any of these cases:

When your license ends, you must stop using the Software and delete it. Sections 4 and 7–21 continue to apply after termination.

16. Disclaimer of Warranties

17. Limitation of Liability

Nothing in these Terms excludes or limits liability for fraud, gross negligence or willful misconduct, or any other liability that cannot be excluded or limited by law.

18. Indemnification

To the extent permitted by law, you will defend, indemnify and hold harmless the Provider against third-party claims, and the resulting losses, damages and reasonable costs, including legal fees. This applies to claims arising from your breach of these Terms, from your violation of any law or third-party right, or from content you capture, convert or share with Parallax. It does not apply to any claim caused by the Provider's own negligence or misconduct.

19. Dispute Resolution; Binding Arbitration (United States)

This section applies if you live in the United States.

(a) Informal resolution first. Before starting any formal proceeding, the person bringing the claim must email a written description of it and the relief sought. The address is support@parallaxwindow.com for claims against the Provider, or the email address on your order for claims against you. Both sides then have 60 days to try in good faith to resolve it. Any time limit for bringing the claim is paused during those 60 days.

(b) Binding individual arbitration. If the dispute is not resolved, any dispute, claim or controversy arising out of or relating to Parallax or these Terms will be resolved by binding arbitration, not in court. This includes any question about the scope or enforceability of this section. The arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and its Mass Arbitration Supplementary Rules where they apply. A single arbitrator decides. The Federal Arbitration Act governs this section. Fees are paid as those rules provide. The arbitration is held by video conference or on written submissions unless the arbitrator decides an in-person hearing is needed; any in-person hearing takes place in the county where you live. The arbitrator may award the same individual relief a court could, but only to the individual party bringing the claim, and only as far as needed for that party's individual claim.

(c) Exceptions. Either side may instead bring an individual claim in small claims court if it qualifies. Either side may also go to court to seek an injunction against infringement or misuse of its intellectual property, or against circumvention of license protections.

(d) Mass filings. Sometimes 25 or more similar arbitration demands are filed by or with the help of the same lawyers or organizations. If so, and the AAA's Mass Arbitration Supplementary Rules do not otherwise provide, the demands are administered in batches of up to 25. Each batch is decided by one arbitrator, and fees are charged per batch. Any time limit for a claim in a later batch is paused until that batch begins.

(e) Opt out. You may opt out of this arbitration agreement by emailing support@parallaxwindow.com within 30 days after you first accept these Terms. Use the subject "Arbitration opt-out" and include your name and the email address on your order. Opting out does not affect any other part of these Terms.

(f) If part of this section fails. If the class, collective or representative waiver in (b) is found unenforceable for a particular claim, that claim (and only that claim) goes to the courts described in section 20 and will not be arbitrated. If any other part of this section is found unenforceable, the rest still applies.

20. Governing Law and Venue

These Terms, and any dispute arising out of or relating to them or to Parallax, are governed by the laws of the State of New Jersey and applicable U.S. federal law, without regard to conflict-of-law rules. The Federal Arbitration Act governs section 19. The United Nations Convention on Contracts for the International Sale of Goods does not apply, and neither does the Uniform Computer Information Transactions Act. Any claim that is not arbitrated must be brought only in the state or federal courts located in New Jersey, and you and the Provider consent to their jurisdiction and venue. If you live outside the United States, the mandatory consumer protection laws of the country where you live still apply to you, and you may also bring proceedings in the courts there where those laws give you that right.

New Jersey residents. Every provision of these Terms applies to New Jersey residents to the fullest extent permitted by New Jersey law. Sections 16–18 do not limit the Provider's liability for its own gross negligence, recklessness, willful misconduct or fraud. Nor do they waive punitive damages that New Jersey law allows for such conduct.
